Terms & Conditions of Use

1. Acceptance of Terms & Electronic Contract Enforceability

These Terms and Conditions of Use ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and the creators and developers of Jaap Karma ("we", "us", "our", or "the Project").

By downloading, installing, accessing, launching, or using the Jaap Karma mobile application, web companion, or associated services (collectively, the "Application" or "Service"), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our companion Privacy Policy.

If you do not agree to each and every term set forth herein, you must refrain from installing, downloading, or using the Application, and if already installed, you must uninstall it immediately.

2. Description of the Service

Jaap Karma is a serene, dignified, non-intrusive, 100% offline-first digital spiritual companion and meditation bead counter created for devotional practice, including:

• Digital Mala Counting: Emulation of traditional 108-bead Japa Malas (as well as 54, 27, or custom bead rounds) with tactile haptic feedback and optional auditory cues.
• Pre-Loaded Traditional Mantras: Access to revered traditional mantras (e.g., Shree Ram, Om Namah Shivaya, Hare Krishna, Gayatri Mantra, Mahamrityunjaya Mantra, and others).
• Custom Mantra Creation: Ability for devotees to register their own personal devotional mantras, deity names, target counts, and transliterations.
• Sankalp (Spiritual Vow) Tracker: Facility to set personal devotional targets, start dates, and track progress toward completing significant spiritual vows (e.g., 100,000 chants).
• Local Spiritual Statistics: On-device calculation of daily chant counts, malas completed, total time spent in meditation, and consecutive practice streaks.
• On-Device Practice Reminders: Optional, locally scheduled reminders for morning (Brahma Muhurta), midday, or evening prayer times.

3. Limited License to Use the Application

Subject to your continuous compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, royalty-free, limited license to download, install, and execute the Application on compatible personal mobile devices and browsers solely for your personal, non-commercial, meditative, and devotional use.

Restrictions on License:

Except as expressly permitted by applicable open-source licenses covering the source code or with prior written permission, you shall not:

• Sell, resell, rent, lease, sub-license, assign, distribute, or commercially exploit the Application binary.
• Reverse engineer, decompile, disassemble, or attempt to derive the underlying binary bytecode, except to the extent permitted by applicable law notwithstanding this restriction.
• Remove, alter, or obscure any proprietary copyright notices, trademarks, or attribution labels from the software interface.
• Bypass, disable, circumvent, or disrupt any security features, technical safeguards, or memory integrity protections implemented in the software.

4. User Conduct, Sacred Reverence & Prohibited Uses

Devotion and mindfulness require peaceful, respectful, and reverent conduct. By using Jaap Karma, you agree to respect the sacred nature of the platform and comply with all applicable laws of the Republic of India and your local jurisdiction.

5. Intellectual Property Rights

A. Proprietary Application Architecture & Brand Assets

The Application's software code, user interface design, digital bead animation engine, color tokens (Sacred Saffron palette), typography hierarchy, custom logos, graphics, sound assets, and documentation are the exclusive intellectual property of the Project and its contributors, protected by Indian and international copyright, trademark, and software intellectual property laws.

B. Sacred Mantras & Universal Cultural Heritage

Traditional Vedic hymns, mantras, Sanskrit shlokas, sacred names of deities (e.g., Gayatri Mantra from Rigveda, Mahamrityunjaya Mantra from Yajurveda, the Maha Mantra from Kali Santarana Upanishad), and spiritual teachings are the timeless, universal cultural and spiritual heritage of humanity. We make no proprietary claims over these sacred texts. They belong to humanity.

6. Spiritual, Karmic & Health Disclaimers

Please read our dedicated Spiritual, Health & Wellness Disclaimer, which is incorporated into these Terms by reference. You explicitly acknowledge and agree that:

• Mindfulness Tool Only: Jaap Karma is a digital counting aid and focus companion. It does not provide medical, psychiatric, psychological, or clinical care.
• No Guaranteed Outcomes: We make zero promises, guarantees, or representations regarding spiritual enlightenment, miraculous divine interventions, karmic remediation, financial prosperity, health cures, or astrological outcomes. Spiritual practice is individual, experiential, and devotional.
• Situational Awareness Safety: You must NEVER use the Application while operating a motor vehicle, riding a bicycle, crossing streets or railway tracks, operating heavy machinery, or engaging in any activity where divided attention could result in injury or death.

7. Local Data Sovereignty & User Backup Responsibility

As set forth in our Privacy Policy, Jaap Karma is 100% offline-first. Because there is zero cloud infrastructure:

• We do not possess, store, or have access to your chant counts, custom mantras, or Sankalp records.
• You are solely responsible for safeguarding your device and performing operating system-level backups (e.g., Google Drive Android backup or Apple iCloud backup).
• If you uninstall the Application, clear app storage in device settings, or replace or lose your phone, we cannot recover or restore your deleted data.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY OF HISTORICAL COUNTS, TIMELINESS OF NOTIFICATIONS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL OPERATE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLY WITH ALL PAST OR FUTURE MOBILE OPERATING SYSTEM UPDATES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW IN INDIA AND INTERNATIONALLY, IN NO EVENT SHALL THE PROJECT CREATORS, DEVELOPERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION:

• Loss of accumulated chant statistics, streak counts, or custom mantras resulting from app uninstall, cache purge, OS crash, or hardware malfunction;
• Device hardware damage, battery depletion, or tactile feedback wear;
• Missed or delayed local reminder notifications due to operating system battery optimization or doze modes;
• Any personal dissatisfaction, emotional distress, or reliance upon traditional spiritual disciplines.

IN ALL CIRCUMSTANCES, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APPLICATION SHALL NOT EXCEED ZERO INDIAN RUPEES (₹0) (OR THE EXACT AMOUNT PAID BY YOU FOR THE APP, WHICH IS A FREE UTILITY).

10. Indemnification

You agree to defend, indemnify, and hold harmless the Project creators, maintainers, and contributors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of or access to the Application; (b) your violation of any provision of these Terms; or (c) your violation of any third-party right or applicable Indian criminal or civil statute arising from custom mantras entered by you.

11. Governing Law, Jurisdiction & Dispute Resolution

A. Governing Law

These Terms and any dispute or controversy arising out of or relating to them shall be governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

B. Amicable Dispute Resolution & Conciliation

In the event of any controversy, claim, or grievance arising under these Terms, the parties agree to first attempt in good faith to resolve the dispute amicably through informal discussions and consultation by contacting the Project's Grievance Redressal Officer at [email protected].

C. Exclusive Jurisdiction (India)

If a dispute cannot be resolved through amicable consultation within sixty (60) days, the courts of competent jurisdiction located in New Delhi, India shall have exclusive jurisdiction to hear and determine any suit, action, or proceeding arising out of or in connection with these Terms.

D. International Consumer Rights Carve-Out

Nothing in this section shall deprive consumers residing in the European Union, United Kingdom, or Australia of any mandatory protections or statutory forum rights granted by the consumer protection laws of their country of habitual residence (e.g., non-excludable rights under the Australian Consumer Law or EU consumer regulations).
